Sales Terms

Introduction
This purchase is regulated by the standardized sales terms for consumer purchases of goods over the internet. Internet consumer purchases are primarily governed by the Contract Act, Consumer Purchase Act, Marketing Act, Right of Withdrawal Act, and E-commerce Act, which provide non-waivable consumer rights. The laws are available at www.lovdata.no. The terms in this agreement should not be understood as limiting statutory rights but outline the key rights and obligations of the parties for the transaction.

The Agreement
The agreement consists of these sales terms, information provided in the ordering system, and any specially agreed terms. In case of conflict between the information, specially agreed terms between the parties take precedence, provided they do not contradict mandatory legislation. The agreement will also be supplemented by relevant legal provisions regulating the purchase of goods between businesses and consumers.

The Parties

Buyer: The consumer placing the order, hereinafter referred to as "the buyer".

Price
The stated price for goods and services is the total price the buyer shall pay. This price includes all fees and additional costs. Any additional costs not informed by the seller before purchase shall be borne by the seller.

Contract Formation
The agreement is binding for both parties when the buyer has sent their order to the seller. However, the agreement is not binding if there have been typographical or data entry errors in the seller's offer in the online store or in the buyer's order, and the other party realized or should have realized that such an error existed.

Payment
The seller can demand payment for the item from the time it is sent from the seller to the buyer. If the buyer uses a credit or debit card for payment, the seller can reserve the purchase amount on the card upon ordering. The card is charged the same day the item is shipped. For invoice payments, the invoice is issued to the buyer upon shipment of the item, with a payment deadline specified on the invoice and a minimum of 14 days from receipt. Buyers under 18 years old cannot pay with subsequent invoice.

Delivery
Delivery has occurred when the buyer, or their representative, has taken possession of the item. If the delivery time is not stated in the ordering system, the seller shall deliver the item to the buyer without undue delay and no later than 30 days after the customer's order. The item shall be delivered to the buyer unless otherwise specifically agreed between the parties.

Risk of the Item
The risk for the item passes to the buyer when they, or their representative, have taken possession of the item in accordance with point 6.

Right of Withdrawal
When purchasing an image from Hytteveggbilder.no, the image is produced to order according to your specifications. Goods produced according to your specifications—also known as "custom-made purchases"—are made especially for you, meaning you do not have a right of withdrawal. You retain all other rights, such as the right to make a complaint.

Delay and Non-Delivery – Buyer's Rights and Deadline for Claims
If the seller does not deliver the item or delivers it late according to the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's side, the buyer can, according to the rules in the Consumer Purchase Act Chapter 5, withhold the purchase amount, demand fulfillment, terminate the agreement, and/or demand compensation from the seller. Claims of breach of contract should be made in writing (e.g., email).

Defects in the Item – Buyer's Rights and Complaint Deadline
If there is a defect in the item, the buyer must, within a reasonable time after it was discovered or should have been discovered, notify the seller that they will invoke the defect. The buyer has always complained in time if it happens within 2 months from when the defect was discovered or should have been discovered. Complaints can be made no later than two years after the buyer took possession of the item. If the item or parts of it are meant to last significantly longer than two years, the complaint deadline is five years.
If the item has a defect and this is not due to the buyer or circumstances on the buyer's side, the buyer can, according to the rules in the Consumer Purchase Act Chapter 6, withhold the purchase amount, choose between correction and replacement, demand a price reduction, demand termination of the agreement, and/or demand compensation from the seller. Complaints to the seller should be made in writing.

Seller's Rights in Case of Buyer's Default
If the buyer does not pay or fulfill the other obligations according to the agreement or the law, and this is not due to the seller or circumstances on the seller's side, the seller can, according to the rules in the Consumer Purchase Act Chapter 9, withhold the item, demand fulfillment of the agreement, demand termination of the agreement, and demand compensation from the buyer. The seller can also, under certain circumstances, demand interest on delayed payments, collection fees, and a reasonable fee for uncollected goods.

Guarantee
A guarantee provided by the seller or manufacturer gives the buyer rights in addition to those the buyer already has under non-waivable legislation. A guarantee thus does not imply any limitations on the buyer's right to make complaints and claims in case of delay or defects according to points 9 and 10.

Personal Data
The data controller for collected personal data is the seller. Unless the buyer consents to otherwise, the seller can, in accordance with the Personal Data Act, only collect and store the personal data necessary for the seller to fulfill their obligations under the agreement. The buyer's personal data will only be disclosed to others if necessary for the seller to fulfill the agreement with the buyer or in statutory cases.

Dispute Resolution
Complaints should be directed to the seller within a reasonable time, cf. points 9 and 10. The parties should attempt to resolve any disputes amicably.
